Terms and conditions of purchase

This contractual document will govern the contracting of products and services through this website, owned by RAMÓN BOLÓS BRU, hereinafter referred to as the PROVIDER.

Acceptance of this document implies that the USER has read and understands the content hereof, is a person with sufficient capacity to enter into and be bound by a contract and assumes all the obligations laid down herein.

The conditions will be valid for an indefinite period of time and will be applicable to all contracts made through the PROVIDER's website.

The PROVIDER informs you that the store is responsible and aware of applicable legislation and reserves the right to unilaterally modify the terms and conditions, without this affecting the goods or promotions purchased prior to the modification.

The purpose of this document is to regulate the contractual relationship between the PROVIDER and the USER when the USER agrees by checking the corresponding box during the online contracting process.

The contractual purchase and sale relationship involves the delivery of a specific product or service in exchange for a specific price as publicly displayed on the website.

In order to access the services or products offered by the PROVIDER, the USER must register through the website by creating a user account. Therefore, you must provide the required personal data freely and voluntarily, which will be processed in accordance with applicable regulations on personal data protection, Regulation (EU) 2016/679 of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and the free movement of such data, and detailed in the Legal Notice and Privacy Policy of this website. The USER will select a username and password, undertaking to make diligent use thereof and not to disclose them to third parties, as well as to inform the PROVIDER of their loss or theft, or of possible access by an unauthorised third party, so that the PROVIDER can block them immediately. The USER registered on the website by means of a username and password, for the use and custody of which they are fully responsible, is responsible for the truthfulness of the personal data provided to the PROVIDER.

Once the user account has been created, we inform you that in accordance with the requirements of article 27 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE), the contracting procedure will continue as follows:

- GENERAL TERMS AND CONDITIONS

Unless otherwise indicated in writing, placing an order with the PROVIDER implies the USER's acceptance of these legal terms and conditions. No stipulations made by the USER may differ from those of the PROVIDER unless they have been expressly accepted in advance and in writing by the PROVIDER.

- COMPLAINTS

Complaints will be dealt with as soon as possible, and may be sent to uresim@rbbcosmetics.com. In accordance with article 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online disputes between the USER and the PROVIDER—without the need to resort to the courts of law—through the intervention of a third party called a Dispute Resolution Body, which acts as an intermediary between the two. Said body is neutral and will dialogue with both parties in order to reach an agreement, and may finally suggest and/or impose a solution to the dispute.

- FORCE MAJEURE

The parties will not be liable for any fault or failure due to force majeure. Performance of the obligation will be delayed until the case of force majeure has ended.

- POWERS

The USER may not assign, transfer or convey the rights, responsibilities and obligations contracted in the sale. If any provision of these terms and conditions is held to be invalid or unenforceable, the validity, legality and enforceability of the remaining provisions will not be affected or modified in any way. The USER declares that they have read, are familiar with and accept these Terms and Conditions of Purchase in their entirety.

- GENERAL INFORMATION ABOUT THE OFFER

All sales and deliveries made by the PROVIDER will be subject to these Terms and Conditions of Purchase.

No modification, alteration or agreement contrary to the PROVIDER's Commercial Proposal or set forth herein will have effect unless expressly agreed in writing and signed by the PROVIDER, in which case, these particular covenants will prevail.

The PROVIDER reserves the right to modify its specifications with regard to the information provided in its advertising, as long as it does not affect the value of the products offered. These modifications will also apply if, for whatever reason, the possibility of supplying the products offered is affected.

- PRICES

The prices indicated for each product include Value-Added Tax (VAT) or other taxes that may be applicable. Unless expressly stated otherwise, these prices do not include the costs of shipping, handling, packaging, insurance or any other services additional and auxiliary to the product or service purchased.

The prices applicable to each product are as published on the website and will be given in EUROS. The USER assumes that the prices of some of the products may vary in real time.

Before making your purchase, you will be able to check all the details of the offer online: items, quantities, price, availability, transport costs, charges, discounts, taxes and the total amount of the purchase. Prices may vary daily until the order is placed.

Once the order has been placed, prices will be maintained regardless of whether or not the products are available.

All payments made to the PROVIDER will be invoiced to the registered USER or to the company indicated by the USER when placing the order. This invoice will be sent with the purchased product, and in PDF format to the email address provided by the USER.

- APPLICABLE LAW AND JURISDICTION

These terms and conditions will be governed by or construed in accordance with Spanish law in all matters for which it does not expressly provide. The PROVIDER and the USER agree to submit any dispute arising from the provision of the products or services covered by these Terms and Conditions to the courts and tribunals of the USER's domicile.
